QUOAD, prep. In Sc. Law phrs.: 1. quoad sacra, applied to a parish which functions only in regard to religious as opposed to civil matters (see Pairish). These parishes have been gen. created as a result of the orig. parish becoming too populous for one church and minister to serve but the orig. parish remains the unit for various civil administrative purposes; 2. quoad ultra, as regards the rest, used in the written pleadings of an action to indicate the point beyond which the defender makes no further admission of the pursuer's allegations. When a part of the parish is disjoined, or annexed quoad sacra merely.
Sc. 1844 Acts 7 & 8 Vict. c. 44. § 8:
To mark out and designate a district to be attached thereto quoad sacra, and to disjoin such district quoad sacra from the parish or parishes to which the same, or any part thereof, may have belonged or been attached, and to erect such district into a parish quoad sacra in connexion with the church of Scotland.
Sc. 1933 J. R. Fleming Ch. in Scot. 209:
Quoad sacra parishes, i.e. those that were created for ecclesiastical purposes under the Endowment Scheme [1844].
Sc. 1948 J. T. Cox Practice Ch. Scot. 644:
A Petition for the Erection of a Church extension charge into a Church and Parish Quoad Sacra shall be made to the General Assembly at the instance of the Minister and the provisional Kirk Session.
2. Sc. 1894 J. Trayner Lat. Maxims 527:
This phrase is of very frequent use in pleading. A defender admits a certain part of the pursuer's statement and quoad ultra denies it; that is, he denies everything beyond that which he has specifically admitted.
