GESTIO PRO HAEREDE, n. Sc. Law: the handling of an estate by an heir without a formal order (Sc. 1754 Erskine Principles iii. viii. §§ 382, 385).Sc. 1839 G. J. Bell Principles § 1917:
The heir will be responsible though he evade the form, if he enjoy the benefit of an entry as heir; and such evasion is called . . . a Passive title. Of these there are two in Heritage; Praeceptio haereditatis, and Gestio pro haerede.Sc. 1946 A. D. Gibb Legal Terms 38:
Gestio pro haerede. Occurs when a person behaves as though he were heir, thereby incurring liability for debt up to the value of the estate to which he succeeds.
